Man sentenced to prison for assaulting neighbor with baseball bat

HART — A 25-year-old Shelby man was sentenced to a minimum of one year and two months to a maximum of four years in prison for a conviction of assault with a dangerous weapon in Oceana County’s 51st Circuit Court Monday, Feb. 23.

Moises Alejandro Garza used a wooden baseball bat to assault his 41-year-old male neighbor at the Chapita Hills apartment complex parking lot, Dec. 9, 2025, said Oceana County Prosecuting Attorney Joseph Bizon.

Garza pleaded guilty to the charge Jan. 26. He received credit for 69 days served in jail.

“We have no specific information on the injuries, but the investigating officer spoke to the victim at the Shelby ER,” said Prosecutor Bizon.

“What happened was the victim was having an argument with Moises Garza’s brother over some tools. That argument became physical. Moises intervened with a wooden baseball bat. This was an unnecessary escalation and does not meet the definition of defense of self or others.” 

Garza also received concurrent one-year jail terms from Judge Susan K. Sniegowski for probation violation convictions Monday. He was convicted in 2021 of methamphetamine possession in both files. He received credit for 339 days served in jail.

The new crime was the basis for the probation violations. The prosecutor said he has no knowledge of alcohol or drugs being a factor in the assault.
