Rothbury woman arrested for drunk driving 3 times in 3 months

HART — A 50-year-old Rothbury woman who amassed three operating while intoxicated charges in Oceana County’s 79th District Court within a three-month period pleaded guilty to all three counts simultaneously, allowing her to avoid being prosecuted as a repeat offender.

Jacki Lynn Boutell was arrested for drunk driving by the Oceana County Sheriff’s Office July 13, 2025. Then, Boutell was arrested by the Michigan State Police Aug. 22, 2025 and again on Oct.10, 2025.

“In order for someone to be charged and convicted with operating while intoxicated — second or third offense, they have to have one or two previous convictions for specific driving under the influence offenses,” explained Oceana County Chief Assistant Prosecuting Attorney Kevin Harrington. “Ms. Boutell accumulated all three of her operating while intoxicated charges before she was ever convicted of the first offense. Therefore, every charge had to be treated as a first-offense operating while intoxicated.”

Boutell pleaded guilty and was sentenced in three cases by Judge John Middlebrook Nov. 25, 2025, according to court records. She received the following concurrent sentences: 

  • July case: 23 days in jail with credit for time served; one year probation; inpatient rehabilitation treatment program; and $1,155 in fines and costs. 
  • August case: 28 days in jail with credit for time served; one year probation; inpatient rehabilitation treatment program; and $620 in fines and costs.
  • October case: 21 days in jail with credit for time served; one year probation; inpatient rehabilitation treatment program; and $400 in fines and costs.
Michigan law, specifically MCL 257.625(9)(b) and (c), establishes the sentencing rules for the subsequent OWI convictions, said Harrington. “Her bond was revoked, and I believe that came after the third charge. The bond was later modified to allow her to attend an inpatient program, which she attended and completed.”

Boutell was represented by defense attorney Terry Nolan in all three files.
