HART — A 28-year-old Hart man was sentenced to 16 months to 10 years in prison for a conviction of assault with intent to do great bodily harm less than murder in Oceana County’s 51st Circuit Monday, May 5.
Gilberto Miguel Colon pleaded “no contest” to the charge, March 10.
“They were traveling in a car on 72nd Avenue, and (the brother) was in the front passenger seat,” said Oceana County Prosecuting Attorney Joseph Bizon. “Gilberto was behind him. They were arguing over legroom, and Gilberto began to choke his brother from behind.
“As the brother was describing the event to police, (he) was spitting out blood.”
No weapon was used in the assault, which occurred Jan. 22.
Colon received credit for 104 days served in jail and was ordered to pay $198 in fines and costs.
In a separate file, he pleaded “no contest” to methamphetamine/ecstasy possession and was sentenced to 112 days in jail with credit for 112 days served and $198 in fines and costs. One count of malicious destruction of property was dismissed.
In 2016, he was sentenced to 21 months to 15 years in prison for a conviction of third-degree criminal sexual conduct (CSC) in Oceana County.
