HART — A 41-year-old Holland man pleaded “no contest” to gross indecency between a male and female in Oceana County’s 51st Circuit Court Monday, July 15.
Christopher Matthew Kubacki committed gross indecency involving a 10-year-old girl at a local hotel. Kubacki will serve 13 months to five years in prison and must register as a sex offender for the rest of his life, said Oceana County Prosecuting Attorney Joseph Bizon.
Charges of first-degree criminal sexual conduct (CSC) and second-degree CSC will be dismissed.
The incident occurred at the Days Inn hotel on Pere Marquette Highway in Summit Township in Mason County, Oct. 21, 2023, said Prosecutor Bizon. “This was believed to be Oceana County and was not discovered to be Mason County until after the matter was bound over to circuit court,” said Bizon. “There is a statute that allows jurisdiction up to 1 mile into a bordering county.” All the parties agreed to keep the matter in Oceana County court.
“Kubacki — with a considerable amount of discussion, input, and agreement from the victim and the adult representing her interests — pleaded no contest to the gross indecency charge,” said Bizon. “This was a reasonable outcome, because while there were legal theories to proceed on, the facts did not easily and unequivocally fit into the other charges, and all elements of an offense need to be proven beyond a reasonable doubt. This is a good outcome and I am told the victim and adult custodian are pleased with the outcome.”
Kubacki served previous prison terms for third-offense operating while intoxicated/impaired/under a controlled substance and fleeing police, according to Michigan Department of Corrections records. He was on parole at the time of his most recent offense.
The maximum term for gross indecency between a male and female is five years in prison. He is scheduled to be sentenced next month.
