HART — A 34-year-old Rothbury man faces multiple charges — including custodial kidnapping — after recently taking his teenage daughter on a crime spree that involved stealing a car from the Winston Road Speedway, according to Lt. Shane Hasty of the Oceana County Sheriff’s Office.
Daniel Lawrence Marcinak, whose address is listed as 1100 Harris Rd. in his court file, faces felony charges of kidnapping — custodial interference, breaking and entering a building with intent and unlawful driving away of an automobile/car theft.
“Marcinak lost his parental rights some years ago,” said Lt. Hasty. “He does have a 16-ish year old daughter still living in the area, and he is somehow able to stay in touch with her. He talked her into running away from the foster parents’ residence to be with him. They stole a car from Winston Speedway. They then did several breaking and enterings into residences between here and Osceola County. Osceola attempted to stop the vehicle, and there was a chase which resulted in a crash. He was arrested in Osceola for many violations and was in their jail. The daughter was returned to the foster parents after the chase/crash.”
Marcinak is scheduled to appear in Oceana County’s 79th District Court for a probable cause hearing Tuesday, Oct. 18, at 3 p.m. His bail was set at $25,000/cash.
According to the Offender Tracking information System, Marcinak is incarcerated in prison on felony convictions of fourth-degree fleeing police and receiving and concealing a stolen vehicle stemming from the Osceola case.
