HART — An 18-year-old Shelby man pleaded guilty to third-degree criminal sexual conduct (CSC) in 27th Circuit Court Thursday, Oct. 15, after having sex with an 18-year-old woman who was asleep due to the effects of a marijuana edible.
Lazaro Daniel Madrigal, of 101 72nd Ave., was arrested last winter by the Michigan State Police and lodged in the Oceana County Jail on a $10,000/cash/surety/10 percent bond, according to court records.
Madrigal will serve up to six months in jail and be placed on Holmes Youthful Trainee Act (HYTA) probation, according to Oceana County Prosecutor Joseph Bizon. The victim agreed to the sentence, said Bizon.
“Friends were hanging out,” Bizon said. “They consumed/shared an edible, and he penetrated the victim without her consent.” The victim was “under the effects of the edible and went to sleep,” and she awakened to Madrigal sexually assaulting her.
“She reported the CSC to a teacher who helped the victim go to the police.”
Sentencing is being scheduled in December, according to court staff.
Third-degree CSC is punishable by up to 15 years in prison.
