Rothbury man sent to jail for CSC.

HART — A 63-year-old Rothbury man was sentenced in 27th Circuit Court Monday, Aug. 24, to nine months in jail for a conviction of fourth-degree criminal sexual conduct (CSC), which is a high-court misdemeanor.

Monty Lee Jerry, of 5293 120th Ave., pleaded guilty to the charge June 29. Jerry was also placed on probation for five years and must register as a sex offender.

The female victim in the case was in the age range of 12-14 years old, according to Oceana County Prosecutor Joseph Bizon. The incidents occurred within the time frame of 2012-2018 in Rothbury, Bizon said.

“The victim in this case approved this outcome,” said Bizon. “It was determined to be the best outcome for the defendant and considered all the circumstances of the case.

“The doc recommended no jail due to defendant’s age and medical situation — we advocated for jail time so the victim could have justice. The judge agreed that nine months jail was appropriate.”

“He’s quite ill. He has a multitude of health problems,” said defense attorney Joseph Gillard, who listed off several medical conditions including arthritis, diabetes, hypertension, and back problems.

“I read the medical report and the pre-sentence investigation,” said Judge Robert D. Springstead. “I am aware of his physical condition. But I can’t overlook these charges. These charges and what he did warrant jail time.

“If the medical staff at the jail determine that they can’t take care of him, they will communicate it to the court,” said Judge Springstead.

Jerry had no prior criminal record, Gillard said.

He initially faced four felony counts of second-degree CSC, which is punishable by up to 15 years in prison.

Sentencing guidelines in the case are 0-9 months. Jerry received credit for three days served in jail.

Jerry appeared in court Monday via Zoom videoconfercing due to COVID-19.
