HART – The preliminary exam for the operating while intoxicated causing death case that was scheduled for Tuesday, Oct. 15, in 78th District Court was adjourned until Dec. 3, said Oceana County Prosecutor Joseph Bizon.
Amber Rae Davis, 28, of 5855 W. 5th St., Mears, has been charged with a felony of operating while intoxicated causing death in connection to a deadly pedestrian crash on East Madison Road near North 126th Avenue in Crystal Township, Aug. 11.
Scott Parsons, 43, of Hart was struck and killed while crossing the gravel section of East Madison Road shortly after 2 a.m.
Davis faces up to 15 years in prison if convicted. Her bond was set at $25,000/cash/surety/10 percent, which she posted, according to her court file.
Parsons was struck by a 2010 Chrysler Town and Country van driven by Davis, who had failed to stop at the signed intersection of Madison Road and 126th Avenue, said Oceana County Sheriff Craig Mast. He died at the scene.
This is the second time the hearing was delayed. It was originally scheduled for Sept. 3.
“Investigation materials are still forthcoming,” said Bizon. The hearing is slated for 3 p.m.
