Defendant’s constant talking does not impress judge.

HART – A 32-year-old Cheyenne, Wyoming man who was being sentenced for a conviction of delivery/manufacture of a controlled substance Monday, Sept. 23, in 27th Circuit Court, continued talking in front of Judge Robert D. Springstead against the advice of his attorney Terry Nolan.

Adam Cole Kucera pleaded with Judge Springstead to give him a lighter sentence. Kucera stood before the judge for approximately a half hour, talking almost non-stop.

His defense attorney Terry Nolan went on record, stating his client disregarded his advice five times for non-stop talking.

“I just want to tell the court that he has a condition that he is unable to stop talking,” Nolan said.

Kucera asked the judge if his girlfriend could make a statement, and Springstead flat-out said, “No.”

“She really needs me,” Kucera said. “She’s going to be homeless.” His girlfriend, who was seated in the audience area, could be observed sobbing.

Kucera, whose conviction stems from selling drugs at the Electric Forest Festival in Rothbury in 2018, had told his attorney and the court that he had no prior criminal convictions. Upon that information, he was going to be sentenced to a jail term of 45 days. However, the probation department later found out that he has seven prior misdemeanor convictions, which elevated his jail term to 120 days.

Sentencing guidelines in the case are 0-11 months.

“Your personality is offensive, and your lack of taking responsibility is offensive,” Springstead said. “I’m doing 120 days so you get out of our court system and get out of our county.”

Kucera was originally facing two felony counts of delivery/manufacture of a controlled a controlled substance and analogue possession.

He received credit for 38 days served.

After he was finally sentenced, his girlfriend ran out of the courtroom, sobbing.
