HART – A 31-year-old Whitehall man was sentenced to one year in jail for a conviction of felonious assault in 27th Circuit Court Monday, July 29.

Charles Lee England, of 817 Livingston St., threatened his 69-year-old mother with a baseball bat and then resisted arrest by a Michigan State Police trooper, April 12, in Claybanks Township, according to Oceana County Prosecutor Joseph Bizon.

England pleaded “no contest” to felonious assault and resisting arrest, May 20.

England’s mother was not injured nor was the state trooper, Bizon said.

“I was really out of it when it happened,” he said Monday. “I don’t remember the occurrences.”

England’s attorney, Terry Shaw, requested that the no-contact order with his mother be lifted, because his mother is his only family. “She is his only support,” Shaw said.

“If the no contact is lifted, it’s matter of time before we have another problem,” argued Bizon.

Judge Robert D. Springstead said he will maintain the no contact provision, but empowers the probation agent to modify it if the agent deems it’s appropriate.

Springstead gave England credit for 108 days served in jail and ordered probation for two years.

The maximum penalty for assault with a dangerous weapon is four years in prison and assaulting/resisting/obstructing a police officer is two years.

Sentencing guidelines in the case are 10-23 months.
