HART – A 22-year-old convicted sex offender was sentenced to concurrent prison terms of two to 15 years for third-degree criminal sexual conduct and two to four years for probation violation in 27th Circuit Court Monday, March 4.
Thomas Allen Clark, of 302 Sunflower Lane, Fremont, is already a registered sex offender stemming from a December 2014 conviction of accosting a minor child for immoral purposes. Clark, who was 18 years old at the time, was ordered to serve three months in jail of a six-month discretionary term and five years probation in February of 2015 for accosting a 15-year-old girl via the Internet.
Last December, Clark was arrested by the Hesperia Police Department for the recent CSC charge arising out of the sexual assault of an 18-year-old woman that occurred in Hesperia last November, said Oceana County Prosecutor Joseph Bizon.
In the 2014 case, Clark testified that he asked the child to engage in sex. However, no sexual contact occurred. In the more recent case, Clark had non-consensual sex with the victim, Bizon said.
He received jail credit for 213 days served for the probation violation conviction and 193 days served for the CSC conviction.
Clark will be subject to lifetime electronic monitoring and must register as a sex offender for the rest of his life.
Third-degree CSC is punishable by up to 15 years in prison, and accosting children is a four-year felony.
