HART – A 34-year-old Shelby man who pleaded “no contest” to second-degree criminal sexual conduct (CSC) – victim under 13 years old – will be deported to Mexico for his conviction.
Ciro Dealmonte, of 331 W. 6th St., faces serving one year in the Oceana County Jail prior to his deportation.
Dealmonte testified through a Spanish interpreter that he had a 10-year-old girl touch him inappropriately.
“After jail, the federal government will re-evaluate his residency status and deport him,” said Oceana County Prosecutor Joseph Bizon. Dealmonte was “a lawful resident but is not a US citizen.”
The Michigan Department of Corrections recommended a one-year jail term, Bizon said. Dealmonte had no prior criminal record before the conviction.
Dealmonte was highly intoxicated and under the influence of cocaine at the time of Jan. 1, 2019 incident in the Village of Shelby, said Bizon. His lack of ability to remember the events of the crime was grounds for a “no contest” plea.
The maximum penalty for second-degree CSC is 15 years in prison.
Sentencing guidelines in the case are 0-17 months
Sentencing is set for April 22 at 9. a.m.
