78th District Court sentencings, dismissals.

HART – The following were sentenced recently in 78th District Court:

– Rosa Amelia Rodriguez, 56, of 3990 W. Baker Rd., Shelby, was found guilty Feb. 11 of operating while impaired and was sentenced to outpatient treatment; 93 days discretionary jail for one year with credit for two days served; no alcohol; subject to random alcohol testing; and $1,040 in fines and costs. One count of operating while intoxicated was dismissed.

– Janet Ann Meyers, 58, of 2295 Pine Grove Dr., New Era, was found guilty Feb. 11 of operating while impaired and was sentenced to outpatient treatment; 93 days discretionary jail for one year with credit for two days served; six months probation; no alcohol/drugs; must submit to testing, searches and counseling as directed by probation; must attend Alcoholics Anonymous (AA) twice a week for two years; must complete the Victim Impact Panel; and $1,075 in fines and costs. One count of operating while intoxicated was dismissed.

– Tyler Charles Powers, 28, of 432 Sunset Dr., Newaygo, was found guilty Feb. 11 of operating while impaired and was sentenced to outpatient treatment and $1,065 in fines and costs. One count of operating while intoxicated was dismissed. “Defendant is an inmate in Mason County – no discretionary jail time is ordered,” his court file states.

James Doss Burns, 69, of 480 Hancock St., Pentwater, was found guilty Feb. 11 of operating while impaired and was sentenced to 93 days discretionary jail for one year with credit for two days served; Alcohol Highway Safety Edcuation; no alcohol; subject to random alcohol testing; and $975 in fines and costs. One count of operating while intoxicated was dismissed.

– Arthur Ray Baxter, 54, of 2510 E. Loop Rd., Hesperia, was found guilty Feb. 11 of marijuana possession and was sentenced to one year discretionary jail for one year with credit for two days served and $440 in fines and costs. One felony count of delivery/manufacture of marijuana was dismissed.

Dismissals

– Brian Joseph Haynes, 25, of 173 E. 34th St., Holland, charges of malicious destruction of property (MDOP) less than $200 and assault and battery were dismissed, Feb. 8.

– Logan Nathaniel Duvall, 19, of 84 Ellis St., Shelby, charges of contributing to the delinquency of a minor and minor in possession of alcohol were dismissed, Feb. 8.

– Jesse James Bays, 37, of 7531 48th Ave., Shelby, one count of larceny by false impersonation less than $200 was dismissed, Feb. 8.

– San Juanita Garcia, 48, of 500 Fowler St., Shelby, one count of truancy was dismissed, Feb. 8.

– Devin Harold Welch, of 738 204th Ave., Hesperia, one count of assault and battery was dismissed, Feb. 11.

– Ted Lee Taylor, 60, of 710 E. Main St., Hart, one count of larceny less than $200 was dismissed, Feb. 11. “Defendant paid victim in full.”

– Gary Deangelo Parker, 21, of 913 Pasture Rose St., Joliet, Illinois, one count of trespassing was dismissed, Feb. 12.
