Man pleads ‘no contest’ in school window shooting case.

HART – A 22-year-old Pentwater man pleaded “no contest” to a felony of malicious destruction of property (MDOP) $1,000-$20,000 Monday, Jan. 7, in 27th Circuit Court, after shooting the Pentwater Public School windows with a B-B gun Nov. 21.
Gavin Krueger-Swanderski, of 6137 Wayne Rd., also initially faced two misdemeanor charges of MDOP, which were dismissed Monday in a plea agreement.
Swanderski also shot and shattered vehicle windows in Pentwater. He caused approximately $3,000 in total damages.
“The incident occurred while the school was unoccupied,” previously stated Pentwater Police Chief Laude Hartrum. “At no time were students or citizens in any danger.”
Swanderski, who is currently lodged in the Oceana County Jail, faces a jail term that will not exceed three months, said Oceana County Prosecutor Joseph Bizon. He may also be sentenced under the terms of the Holmes Youthful Trainee Act (HYTA), which allows defendants under the age of 24 with no criminal record to withdraw their plea to a felony and plead to a misdemeanor if they abide by the terms of probation. HYTA cases are non-public.
Swanderski had no previous adult criminal record, Bizon said. Sentencing guidelines in the case are 0-6 months.
He will also be ordered to pay restitution for the damages.
MDOP $1,000-$20,000 is punishable by up to five years in prison, said Judge Bradley G. Lambrix.
Sentencing is set for March 4 at 9 a.m.
