School bus stop accident case transferred to Muskegon County.

HART – The juvenile case against a 16-year-old Hart girl who allegedly struck a 34-year-old Hart man with her car as he was stepping away from a school bus has been transferred to Muskegon County.

John Fishel, who had loaded his children onto the bus, was critically injured after being struck by the passing vehicle, Oct. 25, shortly after 7 a.m. on West Monroe Road in Weare Township.

Oceana County Prosecutor Joseph Bizon recused himself from the case due to a conflict of interest, he said. Muskegon County Prosecutor DJ Hilson said he was appointed special prosecutor just prior to Christmas.

The Hart Public Schools bus was stopped with its emergency flashers on, loading kids on the bus, previously stated Oceana County Sheriff Craig Mast. As the kids were being loaded on the bus, the driver spoke briefly with Fishel about the drop-off schedule because it was a half day of school. As Fishel stepped away from the bus to cross the road, he was struck by the teen who was passing the bus while its flashers were activated.

Fishel was airlifted from Mercy Health Partners Lakeshore Campus in Shelby to Spectrum Hospital in Grand Rapids. OCP was unsuccessful in contacting Fishel or his family for an update on his medical status.

Juvenile cases are confidential and not a matter of public record. In Michigan, a juvenile is age 16 and younger.
