HART – A 37-year-old man from the Detroit area testified in 27th Circuit Court Monday, Nov. 19, that he threw a brick through the window of the Parkside Store in Silver Lake last August.
“I threw a brick through the window,” Wayne Aron Klein of Madison Heights testified. “I was intoxicated and wanted more alcohol.”
Klein pleaded guilty to a misdemeanor of malicious destruction of property $200-$1,000, which carries a maximum penalty of one year in jail. He was initially charged with a felony of breaking and entering a building with intent that was dismissed in a plea agreement.
Judge Robert D. Springstead sentenced Klein to serve two days in jail with credit for two days served and pay $807.40 in restitution.
After Klein threw the brick through the window, he stole two pints of vodka, Oceana County Sheriff Craig Mast previously stated. He was arrested after going back to the store the next day to buy more alcohol.
He stole a pint of Absolute Citron and a pint of Smirnoff Green Apple, each valued at $11.49, Mast said.
“Mr. Klein obviously has a very serious alcohol problem,” said his attorney Matthew Kacel. “He didn’t really remember what happened” the previous night when he came back the next day to buy more alcohol, Kacel said, describing the events as a “bizarre situation.”
Klein has been going to Alcoholics Anonymous and is in the “early in stage of recovery,” the attorney said.
Klein told the judge he had no prior criminal record.
