HART — A 32-year-old Holton man will avoid jail time if he pays restitution totaling $40,649.19 within two weeks after pleading “no contest” to a reduced misdemeanor charge of embezzlement $200-$1,000 in 27th Circuit Court Monday, June 11.

Brandon Taylor Gerth, of 7442 Skeels Rd., was facing up to 10 years in prison following his arrest last September for a felony of a embezzlement $20,000-$50,000.

Gerth “misappropriated sales commissions,” said Oceana County Prosecutor Joseph Bizon, at David Allen Racing Motorsports in Oceana County’s Greenwood Township near Fremont.

Gerth was on probation for an aggravated stalking conviction at the time he committed the offense.

Bizon said he discussed the case with the victim in the case, DAR owner David Schwartz, and he is “far more interested” in receiving the restitution, than sending the Gerth to jail.

“My client has gone to great lengths to make changes in his life,” said Gerth’s attorney Julie Springstead Waltz.

If Gerth does not pay the restitution within two weeks, he will serve one year in jail, said Judge Bradley G. Lambrix.
