HART — A 19-year-old Montague man faces serving up to two years in prison after pleading “no contest” to assault with intent to commit second-degree criminal sexual conduct (CSC) in 27th Circuit Court Monday, Jan. 29.
Justin Scott Theodore, of 3527 W. Webster Rd., must register as a sex offender due to the conviction. The victim in the case is a child under the age of 13, said Oceana County Prosecutor Joseph Bizon. The child’s mother reviewed the plea agreement details and agreed to the terms, Bizon said.
The maximum term for the charge is five years in prison, said Judge Robert D. Springstead.
The incident occurred in the Village of New Era.
Theodore was on Holmes Youthful Trainee Act (HYTA) status for a second-degree home invasion conviction. His HYTA status in that case was revoked due to his recent conviction.
Sentencing is set for April 9 at 9 a.m.
