78th District Court sentencings, posted Sept. 21, 2017.

HART — The following were sentenced recently in 78th District Court:

– Zachary Edward Lahay, 21, of 7621 Alpine Ave., Sparta, Michigan, was found guilty Sept. 18 of disturbing the peace and was sentenced to one day in jail with credit for one day served; 90 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $400 in fines and costs. One count of indecent exposure was dismissed.

– Tammy Sue Boyette, 20, of 515 Jupiter St., Gwinn, Michigan, was found guilty Sept. 18 of non-sufficient fund check $100 or less and was sentenced to 93 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; $74 restitution to Hansen Foods; and $400 in fines and costs.

– Carol Annette Bunker, 44, of 149 Monroe St., Manistee, was found guilty Sept. 18 of second-offense driving while license suspended (DWLS) and was sentenced to 28 days in jail with credit for 28 days served; 93 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $400 in fines and costs. Conviction reportable to the Secretary of State (SOS).

– Jamie Kay McBride, 46, of 9725 Silver Creek Rd., Whitehall, was found guilty Sept. 18 of embezzlement less than $200 and was sentenced to one day in jail with credit for one day served; 93 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; $691 in restitution to Val Du Lakes; and $400 in fines and costs.

– Gerardo Joel Mendoza, 26, of 1404 N. York Rd., Hart, was found guilty Sept. 18 of second-offense DWLS and was sentenced to one year discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $400 in fines and costs. Conviction reportable to SOS.

– Aliea Lyn Moore, 34, of 339 Laurel St., Walkerville, was found guilty June 5 of larceny less than $200 and was sentenced to 93 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $400 in fines and costs. Restitution left open for 90 days.

– Joseph Edward Dykstra, 33, of 3826 S. 128th Ave., Shelby, was found guilty Sept. 12 of second-offense operating while intoxicated and was sentenced to 60 days in jail to be served on weekends; one year discretionary jail to ensure compliance with sentence over the next two years; credit for time served if imposed; must attend AA and give monthly reports to the court for two years; subject to random preliminary breath tests (PBTs); outpatient treatment; and $1,155 in fines, costs and restitution. Conviction reportable to SOS.

– Ismael T. Barrios, 64, of 180 W. Main St., Hart, was found guilty Sept. 12 of DWLS and was sentenced to 90 days at the court’s discretion over the next one year and $300 in fines and costs. Conviction reportable to SOS. One count of operating without insurance was dismissed.

– Breanna Nicole Anderson, 17, of 2372 Cleveland Rd., New Era, was found guilty Sept. 12 of allowing a person to drive in violation and was sentenced to 90 days at the court’s discretion over the next one year and $290 in fines and costs. One count of operating without insurance was dismissed.

Dismissal

– Austin Michael Nead, one count of DWLS was dismissed Sept. 14. “Defendant recently pleaded guilty to a felony charge and was sentenced to a prison term of over one year,” his court file states. “It is not in the interest of justice to go forward with the pending misdemeanor charge of DWLS given the defendant’s current situation.”
