Hesperia man faces prison for probation violation.

HART — A 48-year-old Hesperia man who pleaded guilty to probation violation in 27th Circuit Court Monday, Aug. 28, faces serving a minimum of one and a half years in prison.
David Theodore McDaniel, of 3914 E. Johnson Rd., was arrested for probation violation after testing positive for THC (tetrahydrocannabinol, which is the psychoactive compound in marijuana) Aug. 10.
McDaniel’s plea agreement calls for a cap of 18 months minimum and a maximum of four years in prison, said Judge Robert D. Springstead. He will receive credit for time served in jail.
McDaniel pleaded “no contest” in February of 2016 to assault with a weapon and was sentenced the following March to one year in jail and two years probation. One count of assault with a weapon and one count of delivery/manufacture of marijuana were dismissed.
Sentencing for his probation violation conviction is scheduled for Oct. 23 at 9:30 a.m.
