HART — The following were sentenced recently in 78th District Court:
– Janet Ann Tice, 33, of 217 N. Michigan Ave., Shelby, was found guilty June 5 of third-degree retail fraud and was sentenced to 93 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $120 in fines, costs and restitution.
– Ryan Scott Whalley, 35, of 140 S. Rush St., Pentwater, was found guilty June 5 of second-offense operating while intoxicated and was sentenced to one year discretionary jail to ensure compliance with sentence; credit for time served if imposed; six months probation; has 30 days to remove name off vehicle title or court will immobilize it for 90 days; outpatient treatment; not to purchase/possess a firearm; no alcohol/drugs; subject to testing, searches and counseling required by probation; no assaultive behavior; and $1,765 in fines and costs. Conviction reportable to the Secretary of State (SOS). One count of second-offense driving while license suspended (DWLS) was dismissed.
– Aliea Lyn Moore, 36, of 339 Laurel St., Walkerville, was found guilty June 5 of larceny less than $200 and was sentenced to 93 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $400 in fines and costs. Restitution left open for 90 days. Larceny $200-$1,000 was dismissed.
– Stephanie Marie Christmann, 44, of 9401 W. Buchanan Rd., Shelby, was found guilty June 5 of DWLS and was sentenced to one year discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $440 in fines and costs. Conviction reportable to SOS.
– Santos Gaucin, 32, of 5677 Oneida Trail, New Era, was found guilty June 5 of marijuana use and was sentenced to 90 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $400 in fines and costs. Conviction reportable to SOS. One count of marijuana possession was dismissed.
– Phillip Edward Roberts, Jr., 31, of 111 Church St., Hart, was found guilty June 5 of selling/furnishing alcohol to a minor and was sentenced to 60 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $100 in fines and costs. Conviction reportable to SOS.
– Naomi Mae Breiler, 34, of 4105 Deer Rd., Muskegon, was found guilty June 5 of operating while impaired and was sentenced to 93 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; Alcohol Highway Safety Education (AHSE); and $1,055 in fines and costs. Conviction reportable to SOS. One count of operating while intoxicated was dismissed.
– Lewis Ernest Stone, 60, of 510 S. Hart St., Hart, was found guilty June 5 of third-degree retail fraud and was sentenced to 93 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $427 in fines, costs and restitution.
– Rosa Amelia Rodriguez, 55, of 94 W. Third St., Shelby, was found guilty June 1 of allowing a person to drive in violation and was sentenced to 90 days discretionary jail over the next one year and $290 in fines and costs. One count of operating without insurance was dismissed.
Dismissal
– Tracy Marie Kennedy, 41, of 1464 N. 100th Ave., Hart, one count of truancy was dismissed June 5. “Defendant was able to get he minor child to school on a regular basis after meeting for pretrial May 2, 2017. The child’s attendance was verified by updated attendance records,” her court file states.
