HART — The following proceedings took place recently in 78th District Court:
Arraignments
Felonies
– Isaac Edward Routley, 40, of 1213 N. 122nd Ave., Hart, was arrested by the Oceana County Sheriff’s Office May 20 for a felony of assaulting/resisting/obstructing police and a misdemeanor of reckless driving. Pretrial: June 5 at 3 p.m. Bail: $10,000/cash/surety.
– Epifanio Alvarez, 22, of 302 Michigan Ave., Shelby, was arrested by the
Michigan State Police May 16 for a felony of carrying a concealed weapon and a misdemeanor of operating a vehicle without insurance. Preliminary conference: June 5 at 3 p.m. Bail: $1,000/cash/surety/10 percent.
Misdemeanors
– Edward Allen Dawkins, 45, of 8366 M 20, Hesperia; MSP; attempted failure to comply with sex offender reporting duties. Pretrial: June 6 at 10 a.m. Bail: $1,500.
– Oren Dale Ward III, 46, of 206 E. Shelby Rd., Shelby; OCSO; May 26; second-offense driving while license suspended (DWLS) and open alcohol container in a vehicle. Pretrial: June 6 at 3:15 p.m. Bail: $5,000/cash/surety/10 percent.
– Morgan James Pearson, 20, of 160 S. East St., Walkerville; OCSO; April 29; second-offense DWLS. Pretrial: June 6 at 3:45 p.m. Bail: $3,500/personal.
– Ellen Mae Burns, 24, of 2242 E. Skeels Rd., Holton; OCSO; May 2; DWLS. Pretrial: June 6 at 10:30 a.m. Bail: $1,000/personal.
– Brody Alexander Penoyer, 21, of 1066 E. 98th St., Grant; May 13; OCSO; driving while license not valid. Pretrial: June 6 at 10:15 a.m. Bail: $1,500/personal.
– Roni Kaye McClernan, 5576 S. 148th Ave., Hesperia; May 5; Oceana County Animal Control; failure to provide animal with adequate care. Pretrial: June 6 at 4:15 p.m. Bail: $1,500/cash/surety/10 percent.
Sentencing
– Mark Alan VandenHeuvel, 54, of 3677 Pere Marquette Highway, Ludington, was found guilty May 23 of allowing a person to drive in violation and was sentenced to 90 days discretionary jail to ensure compliance with court orders; credit for time served if imposed; and $290 in fines and costs. One count of operating without security was dismissed.
Dismissals
– Angela Marie Alltop, 41, of 1588 E. Hammett Rd., Hart, one count of truancy was dismissed May 23. “After meeting with the defendant mother, it appears that this matter should be handled by the juvenile court,” her court file states.
– Jasen Lee Tyler, 51, of 8518 Robinhood Dr., Montague, one count of delivery/manufacture of marijuana was dismissed “without prejudice” May 22.
– Jonathon Rovert McClernan, 20, of 5576 148th Ave., Hesperia, one count of minor in possession of alcohol was dismissed “without prejudice” May 22.
A dismissal without prejudice means that the prosecution is not barred from re-filing charges within the applicable limitations period.
