HART — A 54-year-old Hart man pleaded guilty to larceny in a building Wednesday, Feb. 22, in 27th Circuit Court, testifying that he stole a purse from a shopping cart at the Cherry Hill Supermarket in Shelby last December.

Sidney B. Fuller, of 3761 N. 144th Ave., faces a five-month jail term for his conviction in accordance with the plea agreement. In exchange for his plea, his third-offense habitual offender notice was dismissed, said Oceana County Prosecutor Joseph Bizon.

The maximum penalty for the offense is four years in prison, Bizon said, and sentencing guidelines in the case are 0-11 months.

When Fuller was testifying Wednesday, he first told Judge Anthony A. Monton that he was shopping with his ex-wife and mistakenly took the purse from the cart, thinking it was her purse.

“You’re not charged with a mistake. You’re charged with stealing,” Monton said. The judge said he would not accept Fuller’s plea, and the case would have to go to trial.

Fuller quickly changed his story, admitting that he stole the purse.

“You’re telling me under oath you were stealing?” Monton asked, and Fuller said “Yes.”

The judge accepted his plea and remanded him to the Oceana County Jail to await sentencing, which is set for April 10 at 9 a.m.
