HART — The following were sentenced recently in 78th District Court:

– Daniel Charles Gilmore, 31, of 3134 W. Skeels Rd., Montague, was found guilty Oct. 3 of second-offense operating while intoxicated (OWI) and was sentenced Oct. 31 to one year discretionary jail to ensure compliance with sentence; credit for time served if imposed; outpatient treatment; $1,815 in fines and costs; six months probation; not to purchase or possess a firearm; subject to testing, counseling and searches by probation; no alcohol/drugs; no contact with probationers or felons; and no assaultive behavior. Conviction reportable to the Secretary of State (SOS). One count of third-offense OWI was dismissed.

– David Douglass Brimmer, 47, of 3123 S. 140th Ave., Shelby, was found guilty Oct. 31 of OWI and was sentenced to 93 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; outpatient treatment; and $1,155 in fines and costs. Conviction reportable to SOS. In a separate file, Brimmer was found guilty Oct. 31 of disorderly person – obscene conduct and was sentenced to 90 days discretionary jail to ensure compliance with sentence; credit for time served if imposed; six months probation; and $925 in fines and costs.

– Dylan Anthony Nichols, 21, of 8503 Robinhood Dr., Montague, was found guilty Oct. 31 of operating without security (no insurance) and was sentenced to one year discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $400 in fines and costs.

– Joseph Owen Pulsipher, 39, of 1490 Baseline Rd., Shelby, was found guilty Oct. 31 of no insurance and was sentenced to one year discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $400 in fines and costs. One count of marijuana possession and one count of operating an unregistered vehicle were dismissed.

– Jacob Ezekiel Graff, 25, of 30 Stag Land, Greenwich, Connecticut, was found guilty Oct. 31 of controlled substance use and was sentenced to one year discretionary jail to ensure compliance with sentence; credit for time served if imposed; and $450 in fines and costs. Conviction reportable to SOS. One count of possession of analogues was dismissed.

– Nicholas Jay Pickard, 28, of 3645 Cedar, Twin Lake, was found guilty Nov. 1 of driving while license suspended (DWLS) and was sentenced to 93 days at the court’s discretion over the next year and $400 in fines and costs. Conviction reportable to SOS.

Dismissals

– David Edward Heyboer, 24, of 8015 N. Maple Island Rd., Bitely, one count of operating an ORV contrary to regulations on public land was dismissed Oct. 31. “Defendant has met all conditions of deferred sentence,” his court file states.

– Richard Allan Windell, 70, of 4059 Colonial Dr., Hart, one count of disorderly person – jostling was dismissed Oct. 31. Defendant met the terms of a deferred sentence, according to his court file.

– Jodi Rene Boardwell, 44, of 312 Walnut St., Shelby, one count of improper transport of medical marijuana was dismissed Nov. 1 “on the motion of the court without prejudice,” court records state.

– Joshua Lamont Moore, 31, of 415 Hart St., Hart, one count of illegal sale/use of a financial transaction device was dismissed Oct. 31 “on the motion of the court without prejudice,” court records state.
