HART — The felony case against a 29-year-old Midland man accused of delivery of heroin causing death that was dismissed last August has been re-filed in 78th District Court.

Daniel Ryan Murphy, 30, of 4501 Congress Dr., was arraigned March 24 following his arrest by the Oceana County Sheriff’s Office for felonies of delivery of a controlled substance causing death and two counts of felony firearms.

It is alleged that Murphy delivered heroin to Jack Kinchen, 30, of Walkerville, who died Sept. 24, 2014 in Colfax Township.

Murphy’s case was dismissed last year without prejudice “as the investigative team and I felt there was evidence that needed further evaluation,” Oceana County Prosecutor Bizon said previously. 

A conviction of delivery of a controlled substance causing death is punishable by up to life in prison.

Murphy’s bail was set at $10,000/cash/surety/10 percent. A preliminary exam is scheduled for April 25 at 3 p.m.
