78th District Court sentencings

HART — The following were sentenced recently in 78th District Court:

– Shawn Donald Pitre, 21, of 1522 W. 17 Mile Rd., Bitely, was found guilty Nov. 2 of second-offense operating while intoxicated. He was sentenced to nine days in jail; one year discretionary jail to ensure compliance with court orders; credit for time served if imposed; outpatient treatment; six months probation; no alcohol/drugs; subject to counseling, testing and searches as required by probation; and $1,780 in fines and costs. Conviction reportable to the Secretary of State (SOS). One count of second-offense driving while license suspended (DWLS) was dismissed.

– Brian Allen Moschke, 31, of 2248 S. 28th Ave., Shelby, was found guilty Nov. 2 of operating a motor vehicle without security and sentenced to one year discretionary jail to ensure compliance with court orders; credit for time served if imposed and $400 fines and costs.

– Jay Benton Brown, 33, of 5737 W. Duna Vista Dr., Pentwater, was found guilty Nov. 2 of operating while impaired. He was sentenced to 93 days discretionary jail to ensure compliance with court orders; credit for time served if imposed; Alcohol Highway Safety Education (AHSE); and $1,055 in fines and costs. Conviction reportable to SOS. One count of operating while intoxicated was dismissed.

– Todd Allen Smith, 43, of 2088 Joy St., Mears, was found guilty Nov. 2 of improper transport of medical marijuana. He was sentenced to 93 days discretionary jail to ensure compliance with court orders; credit for time served if imposed; and $400 in fines and costs.

– Mitchell Sidney Fuller, 26, of 2666 116th Ave., Hart, was found guilty Nov. 2 of operating a motor vehicle without security and sentenced to one year discretionary jail to ensure compliance with court orders; credit for time served if imposed; and $400 in fines and costs. Conviction reportable to SOS. One count of driving while license not valid dismissed.

– Lonny Dale Hoffman, 37, of 2863 Brunswick Rd., Holton, was found guilty Nov. 2 of operating while intoxicated. He was sentenced to nine days in jail; 93 days discretionary jail to ensure compliance with court orders; credit for time served if imposed; outpatient treatment; $1,680 in fines and costs; six months probation; take name off title within 30 days or immobilize within 90 days; no alcohol/drugs; subject to counseling, testing and searches as required by probation; and may not purchase or possess a firearm. Conviction reportable to SOS. One count of second-offense operating while intoxicated was dismissed.

– Ronald Dee Robbins, Jr., 53, of 3429 N. 72nd Ave., Hart, was found guilty Nov. 2 of malicious use of telecommunications. He was sentenced to six months discretionary jail to ensure compliance with court orders; and $400 in fines and costs. Time served runs concurrently with a personal protection order violation.

– Fernando Alonzo Pacheco, 22, of 217 W. Filmore Rd., Hart, was found guilty Nov. 2 of operating while intoxicated. He was sentenced to 93 days discretionary jail to ensure compliance with court orders; outpatient treatment; and $1,155 in fines and costs. Conviction reportable to SOS.

– Christopher James Minzey, 31, of 309 E. Hackley Ave., Muskegon, was found guilty Nov. 2 of larceny – less than $200 and sentenced to 93 days discretionary jail to ensure compliance with court orders; and $510 in fines, costs and restitution.
