Sexual assault case heads to trial

HART — The case against a 36-year-old Montague man facing felony charges of second-degree criminal sexual conduct (CSC); third-degree CSC; and delivery of marijuana to a minor is set for trial in January.

Anthony Joseph Aguilera, of 6588 50th Ave., appeared in 27th Circuit Court Monday, Sept. 28, for a pretrial hearing with his attorney, Timothy Hayes. Aguilera rejected a plea deal, said Oceana County Prosecutor Joseph Bizon, and his trial is scheduled to begin, Jan. 6. A final conference hearing is scheduled for Dec. 7.

Aguilera is alleged to have “engaged in sexual acts” with an underage female during a gathering in 2010 that involved the consumption of “a lot of alcohol,” Bizon said.

Aguilera remains free on a $25,000/cash/surety bond.
